LINCOLN COUNTY MAN CHARGED WITH STATUTORY RAPE AND SODOMY OF A CHILD

On February 27, 2017, detectives with the Lincoln County Sheriff’s Office began investigating a criminal complaint of statutory rape of a female under the age of 14-years-old. According to the reporting party, a female under the age of 14-years-old disclosed to them that 24-year-old Derick Fitzsimmons, of Lincoln County, had sex with her several times over a one-year period.

During a forensic interview, investigators learned the sexual contact took place several times in a residence along the 100 block of Banjo Lane, in Lincoln County. It was also learned Fitzsimmons established a safe word during that time in the event the victim felt uncomfortable.

Investigators detained Derick Fitzsimmons at his residence and transported him to the Sheriff’s Office for questioning. Fitzsimmons refused to speak to investigators about the sexual allegations.

Fitzsimmons was taken into custody and charged with two counts of Felony Statutory Rape of a person less than 14-year-olds and five counts of Felony Statutory Sodomy. Fitzsimmons is currently housed in the Lincoln County Jail under a $350,000 cash only bond. According to court documents, upon release, Fitzsimmons must remain on house arrest with a GPS monitoring device and have no contact with the victim. Other conditions of bond may apply.
